By accessing and using DuckScript ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Service.
2. Description of Service
DuckScript is a meeting transcription and analysis platform that provides:
- Real-time audio transcription using AI technology
- Speaker diarization and identification
- AI-powered meeting summaries and analysis
- Audio/video file upload and processing
- Export functionality (TXT, DOCX, JSON, PDF formats)
- Meeting series organization and intelligence
3. User Accounts
3.1 Registration: You must register for an account to use the Service. You agree to provide accurate, current, and complete information during registration.
3.2 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3.3 Age Requirement: You must be at least 18 years old to use the Service.
4. Subscription Plans and Billing
4.1 Plans: DuckScript offers three subscription tiers: Starter (Free), Pro (€15/month), and Business (€35/month). Annual billing is available at a discounted rate.
4.2 Billing: Paid subscriptions are billed in advance on a monthly or annual basis. Charges are non-refundable except as required by law or as specified in our Refund Policy.
4.3 Automatic Renewal: Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.
4.4 Cancellation: You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period.
4.5 Usage Limits: Each plan has specific usage limits (recording hours, number of meetings). Exceeding these limits may result in service restrictions until the next billing period or upgrade.
5. Acceptable Use Policy
You agree NOT to use the Service to:
- Violate any applicable laws or regulations
- Infringe upon the rights of others, including intellectual property rights
- Record conversations without proper consent from all participants
- Upload malicious content, viruses, or harmful code
- Attempt to gain unauthorized access to our systems
- Use the Service for illegal surveillance or harassment
- Resell or redistribute the Service without written permission
- Engage in any activity that disrupts or interferes with the Service
6. Recording Consent and Legal Compliance
IMPORTANT: You are solely responsible for complying with all applicable laws regarding recording conversations, including obtaining proper consent from all participants. Recording laws vary by jurisdiction. DuckScript is not responsible for your compliance with these laws.
7. Content Ownership and Rights
7.1 Your Content: You retain all rights to the audio recordings, transcripts, and meeting data you upload or create using the Service ("Your Content").
7.2 License to Process: By using the Service, you grant us a limited license to process, store, and analyze Your Content solely to provide the Service to you.
7.3 AI Training: We do not use Your Content to train AI models or for any purpose other than providing the Service to you.
8. Data Retention and Deletion
Video recordings are automatically deleted after 30 days on all plans. Transcripts and meeting data are retained until you delete the meeting or your account. You may delete your data at any time through the Service. See our Privacy Policy for details.
9. Service Availability and Modifications
9.1 Availability: We strive to maintain 99.9% uptime but do not guarantee uninterrupted access to the Service.
9.2 Modifications: We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.
10. Intellectual Property
The Service, including its design, features, software, and content (excluding Your Content), is owned by DuckScript and protected by copyright, trademark, and other intellectual property laws.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DUCKSCRIPT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:
- Your use or inability to use the Service
- Inaccuracies in transcriptions or AI-generated summaries
- Unauthorized access to your data
- Service interruptions or errors
12. Indemnification
You agree to indemnify and hold harmless DuckScript from any claims, losses, liability, damages, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or violation of any rights of another party.
13. Termination
We may terminate or suspend your account immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the Service will cease immediately.
You may terminate your account at any time through your account settings or by contacting support.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions.
15. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use of the Service after such notice constitutes acceptance of the updated Terms.
